1. Acceptance of Terms

By accessing or using SharpCue (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SharpCue provides AI-powered analytics, signal generation, and paper-trading simulation tools for prediction markets including Kalshi and Polymarket. SharpCue does not provide financial, legal, or betting advice. All content is for informational and educational purposes only.

3. Eligibility

You must be at least 18 years of age and legally permitted to engage with prediction markets in your jurisdiction. By using this Service, you represent that you meet these requirements and that your use complies with all applicable laws.

4. Not Financial or Betting Advice

Nothing on SharpCue constitutes financial advice, investment advice, or a recommendation to place any wager on any prediction market. All signals, scores, and analyses are generated algorithmically and may be inaccurate. You are solely responsible for any decisions you make based on information from this Service.

5. Prediction Market Risk Disclosure

Prediction markets involve real financial risk. You may lose the entire amount you wager. Past signal performance is not indicative of future results. SharpCue makes no guarantee of profitability. Never wager more than you can afford to lose.

6. No Custody of Funds

SharpCue does not hold, manage, or have access to your funds. Any real-money activity occurs directly on third-party platforms (Kalshi, Polymarket) under their own terms and conditions. Your API keys and account credentials remain under your sole control.

7. Paper Trading & Sandbox Mode

SharpCue’s Sandbox mode simulates wagers using virtual currency with no real-money consequence. Paper trade results do not guarantee equivalent results in live markets. Market conditions, liquidity, and pricing may differ significantly.

8. User Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and any API keys linked to your account. You agree to notify us immediately of any unauthorized access. SharpCue is not liable for losses resulting from unauthorized account use.

9. Subscriptions & Payments

Certain features require a paid subscription. All fees are disclosed prior to purchase and are processed securely via Stripe.

• No Refunds: All subscription payments are final and non-refundable, including for change of mind, lack of use, or failure to cancel before renewal.
• Cancellation: You may cancel at any time through your profile settings. Access continues until the end of the billing period; no further charges are made.
• Pricing Changes: We may update pricing with at least 30 days’ notice to existing subscribers.

10. Prohibited Conduct

• Using the Service for any unlawful purpose or in violation of any regulation.
• Attempting to reverse-engineer, scrape, or disrupt the Service.
• Misrepresenting your identity or providing false information.
• Using SharpCue to manipulate prediction markets or engage in fraudulent activity.

11. Intellectual Property

All software, models, signals, and content provided by SharpCue are owned by or licensed to SharpCue and protected by applicable intellectual property law. You may not copy, distribute, or create derivative works without prior written consent.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee accuracy, completeness, or availability of any signals, data, or analyses.

13. Limitation of Liability

To the maximum extent permitted by law, SharpCue and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including any trading or wagering losses, arising from your use of the Service.

14. Indemnification

You agree to indemnify and hold SharpCue harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts of Texas.
